[vc_row][vc_column][vc_custom_heading source="post_title"][vc_column_text]The Legislative Assembly of the Republic of El Salvador reformed the Electoral Code last July 2017. Among these modifications is mainly the one contemplated in Art. 113 of said normative body and that has a direct impact on numeral 6 of Art. 29 of the Labor Code. The reformed provision obliges employers to grant leave to their staff who have been selected by the Supreme Electoral Tribunal (TSE) and have been assigned or conferred a specific position or appointment to form any Electoral Body or temporary or permanent surveillance. The legal provision determines that employers are obliged to grant leave with pay if electoral activities occur on days and hours that are normally working. This license is not limited to the date of the elections for municipal deputies and mayors on March 4, 2018, but also extends to the periods designated for the pre-training of members of the Electoral Bodies in accordance with the law, including the final vote count. To properly verify such participation, the Supreme Electoral Tribunal will issue the corresponding credentials to the members of the Electoral Boards. In the case of Voting Reception Boards, Heads of Centers, and Supervisors, their participation will be certified through forms provided by the Supreme Electoral Tribunal, signed and sealed by the Secretary of the Municipal Electoral Board or Departmental Electoral Board, as applicable. Legislative Decree No. 748, which contains the aforementioned reforms, is attached.
