Obtaining the Operating Permit for Hydrocarbon Deposits or Tanks for Own Consumption from the Ministry of Energy

[/vc_column_text][us_separator][vc_column_text]The operation of hydrocarbon tanks or deposits for personal consumption in Honduras requires obtaining an Operating Permit issued by the Ministry of Energy. This process involves following a series of steps and complying with specific requirements established by law. In this article, we will explore in detail the steps and requirements necessary to obtain this permit.

  1. Formal Request:The first step is to submit a written application that meets the requirements established in Article 61 of the Administrative Procedure Law. This document must include complete and accurate information about the activity to be carried out.
  1. Location Data:In the application, it is crucial to clearly state the exact address of the establishment. This provides vital information for the evaluation and approval of the permit.
  1. Legal Representation:A power of attorney from the legal representative must be attached, along with their national identification document. Additionally, if you have a legal representative, a corresponding power of attorney and a current card issued by the Honduran Bar Association are required.
  1. Municipal Permit:A valid Operating Permit issued by the municipal government where the establishment is located is required. This document confirms the legality of the operation at the specific location.
  1. Contingency Plan:Safety is a priority. To achieve this, you must obtain a document issued by the Heroic and Meritorious Fire Department of Honduras approving the facility's contingency plan.
  1. Technical Details:Provide a table explaining the storage capacity (nominal and operational) for each pipe, hose, and tank, as well as the stored product. The ownership or lease status of the facility and tanks must also be included, including the lease agreement, if applicable.
  1. Letter of Intent to Supply:It is essential to have a Letter of Intent to Supply or Hydrocarbon Supply Contract issued by the duly registered hydrocarbon supplier.
  1. Digital Documentation:All documentation must be submitted digitally and sent in advance to the email address ventanillaunica@sen.hn before physical submission.
  1. Payment of Fees:According to SEN Agreement 002-2019, fees must be paid through the TGR (Tax Administration) Receipt for inspection. The amount varies depending on the physical location of the establishment.
  1. Other Payments:Additionally, payments must be made for the Operating Permit and Issuance of Resolution Certification, in the amounts of L 20,000.00 and L 200.00, respectively.
  1. Additional Requirements:The Ministry of Energy may request any other requirements at any stage of the process to clarify or corroborate the information submitted.
  1. Foliated Presentation:For first-time applications, all information must be paginated, following the order listed, and with bullets or tabs properly labeled to identify each requirement.

Meeting these requirements and following these steps guarantees a complete application and facilitates the process of obtaining the Operating Permit for Hydrocarbon Tanks or Depots for Personal Consumption from the Ministry of Energy in Honduras.
