New Labor Compliance Certification in Honduras

On July 10, 2026, Agreement No. SETRASS-323-2026 was published in the Official Gazette La Gaceta, through which the Ministry of Labor and Social Security approved the Regulation for the Certification of Compliance with Labor Legislation. This regulation introduces a voluntary mechanism enabling employers to demonstrate, before the competent authority, compliance with their labor obligations in Honduras.

Although the certification is voluntary, its practical significance may be considerable. In a business environment increasingly focused on risk prevention, due diligence, and regulatory compliance, obtaining a labor compliance certification may become a valuable asset when dealing with clients, suppliers, investors, financial institutions, and administrative authorities.

Key Considerations for Employers

The regulation requires companies to maintain proper compliance in essential labor-related areas, including employment contracts, payment of ordinary and overtime wages, thirteenth and fourteenth month salary benefits, educational bonuses, registration with the Honduran Social Security Institute (IHSS), obligations before the Private Contributions Regime (RAP), vacation benefits, internal work regulations where applicable, and occupational health and safety measures.

Particular emphasis is also placed on internal policies aimed at preventing workplace harassment, discrimination, and prohibited practices related to hiring and employment retention. This confirms that labor compliance should not be limited to the existence of formal documentation, but should also be reflected through consistent and verifiable business practices.

A Useful, But Not Absolute, Tool

The certification does not replace labor inspections conducted by the authorities, nor does it exempt employers from liability for future non-compliance. Therefore, it should be viewed as part of an ongoing culture of compliance rather than a mere administrative procedure. Companies choosing to pursue this certification should ensure that their documentation, internal policies, and labor practices are fully aligned with applicable regulations.

Risks of Proceeding Without Prior Review

Before initiating any certification process, employers are advised to conduct a comprehensive legal review of their labor compliance status. Pursuing certification without adequate preparation could expose contingencies relating to employment agreements, wage compliance, social security obligations, employee benefits, occupational safety measures, or internal corporate policies.

From a preventive standpoint, this new regulation provides companies with an opportunity to identify weaknesses, update documentation, strengthen internal controls, and reduce exposure to future labor inspections or employment-related claims.

Business Impact

For companies with well-structured labor practices, the certification may offer both reputational and commercial advantages. It may also prove valuable in audits, procurement processes, public and private tenders, financing transactions, mergers and acquisitions, and corporate compliance assessments. However, its effectiveness will ultimately depend on the existence of genuine and sustained compliance.

Conclusion

The Certification of Compliance with Labor Legislation represents a new tool within the Honduran labor framework aimed at promoting voluntary compliance and strengthening business formalization. Nevertheless, taking full advantage of this mechanism requires proper preparation, document review, and an effective risk management strategy.
