COVID-19 VACCINE MANDATORY
On September 28, 2021, the National Commission on Vaccination and Epidemiology (CNVE) announced that the COVID-19 vaccine will be mandatory for public officials, in order to address the health emergency that the country has been experiencing for more than a year. Previously, vaccination was mandatory only for frontline pandemic response officials, that is, employees of the Costa Rican Social Security Fund, the Ministry of Health, private medical personnel, the National Emergency Commission, firefighters, the Red Cross, and police forces; however, with this new provision, all public officials must be vaccinated. In addition, the CNVE endorsed private sector employers to take, within their internal labor provisions, the necessary measures to guarantee the safety and protection of their employees, including mandatory vaccination of their workers. That is, private sector employees can now be required to be vaccinated. Section 71 of the current Labor Code establishes that workers are obligated to comply with preventive measures adopted by authorities and employers for the safety and protection of their personnel or workplaces. It is important to note that the country planned to achieve herd immunity between October and December of this year; however, low turnout for the authorities' call for vaccination has led to the adoption of these measures. In the coming days, the executive branch will sign the decree officially establishing mandatory COVID-19 vaccination.
