  1. Introduction

Consumer law has gained increasing relevance within the Honduran legal system due to the growth of commercial relationships between suppliers and consumers. In this context, the State has established administrative mechanisms designed to safeguard consumer rights and regulate the commercial practices of suppliers.

In Honduras, the supervision and processing of complaints related to consumer law violations fall under the authority of the General Directorate of Consumer Protection, an agency attached to the Secretariat of Economic Development of Honduras. This authority is empowered to receive complaints, promote conciliation processes between the parties, and, where applicable, impose administrative sanctions on supplier companies.

The purpose of this article is to examine the administrative complaint procedure in consumer matters and to analyze the legal consequences that may arise for supplier companies, particularly regarding failure to attend conciliation hearings and the potential imposition of sanctions.

  1. Regulatory Framework for Consumer Protection in Honduras

The consumer protection legal framework is primarily governed by the Honduran Consumer Protection Law, which establishes the fundamental rights of consumers and the obligations that suppliers of goods and services must fulfill.

Among the main rights recognized by the legislation are:

  • The right to receive truthful, clear, and timely information regarding the products or services offered.
  • The right to protection of economic interests.
  • The right to safety in consumption.
  • The right to repair or compensation for damages arising from defective products or services.

Suppliers, in turn, are required to ensure that their commercial activities are conducted in accordance with principles of transparency, contractual good faith, and respect for consumer rights.

III. Complaints procedure before the consumer protection authority

The administrative procedure begins when a consumer files a formal complaint before the competent authority. Such complaints may be submitted through various channels made available by the public administration.

  1. Reporting requirements

For the admission of a complaint, the consumer must provide at least the following information:

  • Identification details of the complainant.
  • Identification details of the reported supplier.
  • A detailed description of the facts giving rise to the complaint.
  • Documents or evidence supporting the claim, such as invoices, contracts, warranties, or proof of payment.

Once the complaint has been filed, the administrative authority assesses its admissibility. If the formal requirements are met, an administrative case file is opened.

  1. Summons to conciliation hearing

Upon admission of the complaint, the authority summons the parties to a conciliation hearing, the purpose of which is to promote a voluntary resolution of the dispute.

At this stage, the authority seeks to facilitate an agreement between the supplier and the consumer that resolves the conflict without the need to continue with sanctioning proceedings.

Conciliation agreements may include:

  • Refund of the amount paid;
  • Replacement of the defective product;
  • Repair of the purchased good;
  • Compliance with contractual warranties.

When an agreement is reached, it is formalized in an official record that has legal validity and binds the parties to comply with the terms agreed upon.

  1. Legal consequences of failure to appear at the conciliation hearing

From a business defense perspective, attendance at administrative hearings constitutes a fundamental element of the procedure.

The unjustified failure of the supplier to appear at the conciliation hearing may result in several legal consequences.

  1. Continuation of the administrative procedure

The administrative authority may continue the process even if the supplier fails to appear, meaning that the procedure will proceed based solely on the information and evidence provided by the consumer.

  1. Limitation of the rights of the defense

By not attending the hearing, the company loses the opportunity to:

  • Present evidence,
  • to dispute the facts denounced,
  • to raise legal arguments in their defense.
  1. Possible initiation of sanctioning proceedings

If the authority considers that there are sufficient indications of infringement of consumer regulations, it may initiate administrative sanctioning proceedings against the supplier.

  1. Regime of sanctions applicable to suppliers

Honduran legislation establishes a set of administrative sanctions aimed at ensuring compliance with suppliers’ obligations.

Among the most relevant sanctions are:

  1. Financial fines

Administrative fines may be imposed when practices contrary to consumer protection regulations are established.

The amount of the penalty is usually determined by considering factors such as:

  • the seriousness of the violation,
  • the damage caused to the consumer,
  • the supplier’s recidivism.
  1. Restitution or reparation to the consumer

The administrative authority may order the supplier to:

  • return the money to the consumer,
  • replace the defective product,
  • comply with the warranty offered.
  1. Suspension of commercial practices

In certain cases, the authority may order the suspension of misleading advertising or the modification of contractual clauses considered abusive.

  1. Temporary closure of the establishment

In serious cases or of recidivism, the temporary closure of the commercial establishment may be imposed.

  1. Recommendations for the Legal Management of Consumer Complaints

From a legal business advisory perspective, it is advisable for companies to implement internal mechanisms for the prevention and management of consumer disputes.

Among the most relevant measures are:

  • Establishing clear customer service policies;
  • Properly documenting commercial transactions;
  • Responding promptly to consumer complaints;
  • Appearing at administrative hearings with specialized legal counsel;
  • Promoting conciliation solutions when claims are well-founded.

The adoption of these practices helps reduce legal risks, avoid administrative sanctions, and preserve corporate reputation.

VII. Conclusions

The administrative procedure in consumer protection in Honduras is essential to guarantee the rights of consumers and, at the same time, obliges companies to comply with high legal standards. The active participation of companies, especially in conciliations, is key to their defence and to avoid sanctions. Therefore, prevention, transparency and proper complaint management are essential to maintain the balance between consumer protection and corporate legal certainty.
