The National Congress of Honduras recently passed Decree No. 34-2025, introducing significant amendments to the Credit Card Law. These changes, effective as of June 5, 2025, mark an important step in protecting financial consumers, while also redefining the obligations of issuers, merchants, and entities involved with this payment instrument.

1. Fair interest calculation – Article 36

One of the most critical issues for cardholders has been addressed. With the reform:

  •  Interest will no longer be calculated on the total account statement balance. It will only be applied to the outstanding balance, that is, the unpaid amount after deducting payments made by the customer.
  • Additionally, payments will be applied first to the oldest debts, thereby reducing unnecessary accumulation of interest.
  • This new scheme is particularly relevant for companies managing corporate cards, enabling more predictable and transparent financial planning.

2. Greater transparency and duty to inform

Issuing entities must now provide clearer, more understandable account statements. A detailed breakdown of charges, interest, and balances is expected, allowing users to make informed decisions.

3. Security in in-person transactions – Article 44

  • To reduce fraud and strengthen cardholder protection:All card payments must be processed in the customer’s presence, with proper identification, which is the responsibility of commercial establishments.
  • This requirement does not apply to digital transactions or e-commerce, thereby preserving flexibility for online operations.

4. Strengthening the role of the CNBS

The National Banking and Insurance Commission (CNBS) expands its regulatory and supervisory powers, now authorized to:

  • Issue supplementary regulations.
  •  Oversee the implementation of the new interest regime.
  • Sanction abusive or unlawful practices. It is expected that in the coming months, the CNBS will issue regulations clarifying operational and compliance aspects.
