A CONTENTIOUS COURT ISSUES A DECISION ORDERING THE REPEAL OF THE OBLIGATION TO DISPLAY THE QR CODE VACCINATION SCHEDULE IN FAVOR OF THE TOURISM SECTOR.

[/vc_column_text][us_separator][vc_column_text]This resolution was issued by the Administrative Litigation Court of the Second Judicial Circuit of San José, Goicoechea, at 11:05 p.m. on November 12 of the current year, and which literally states: “…. Consequently, this precautionary request is ADMITTED, for which reason THE IMMEDIATE SUSPENSION of the effects of the resolution of the Ministry of Health no. MS-DM-8119-2021 of October 14, 2021, is ORDERED, only insofar as it orders the demonstration of a vaccination schedule through a QR code, which was arranged as mandatory verification for both the commercial establishments indicated in the indicated resolution, as well as for individuals or users thereof…”. “….Likewise, given that it has current effects, but also given the potential but certain permanence of the effects of this mandatory measure (requirement of a QR code), it was brought to the attention of the Presidential House through a communication number CP-1273-2021 dated October 22, 2021, as a precautionary measure, the President of the Republic, the Minister of Health, the Minister of Science, Innovation, Technology and Telecommunications, the COSTA RICAN SOCIAL SECURITY FUND, and the COSTA RICAN ELECTRICITY INSTITUTE are ORDERED to refrain from any conduct tending towards the implementation of the QR Code, at a commercial, social, labor, tourist, recreational and/or any other level, until this matter is resolved on the merits, in order to safeguard the precautionary judicial protection adopted in this resolution….” In light of the above, businesses, hotels, restaurants, and tourist activities will no longer be able to use QR codes to verify citizens' COVID-19 vaccination status; however, we must wait for the State to rule on the aforementioned resolution, so the Court can determine whether or not the measure is upheld.
